Form 130 (formerly Form 16): what employers need to know

Form 16 has a new name and a new layout under the Income-tax Act, 2025. Here is which form applies to which year, and what changes for employers.

Last reviewed: 30 October 2026 · By the AiroHR team

Key points

  • Form 130 replaces Form 16, and Form 138 replaces Form 24Q, under the Income-tax Act, 2025.
  • FY 2025-26 was the last year on Form 16. Tax Year 2026-27 is the first on Form 130.
  • The first Form 130 is due by 15 June 2027.
  • Form 130 has three parts, and each employer in the year issues its own.
Form 130 replaces Form 16 and Form 138 replaces Form 24Q under the Income-tax Act, 2025. Tax Year 2026-27 is the first on Form 130, first due by 15 June 2027.

What changed

The Income-tax Act, 2025 took effect on 1 April 2026 and replaced the 1961 Act. The rules and forms were renumbered, and the idea of "financial year" and "assessment year" was replaced by a single tax year. Tax Year 2026-27 runs from 1 April 2026 to 31 March 2027.

So the form does not change for this year's filing season. Salary you are paying now, in Tax Year 2026-27, will be reported on Form 130 next June.

Common mistake: reading "from 1 April 2026" as meaning Form 130 was due in 2026. That date is when the new Act began. The first certificate covers the year that started then.

The three parts

PartHolds
Part AEmployer's name, address, TAN and PAN; employee's name and PAN; the tax year; the period of employment.
Part BTDS summary: amounts paid, tax deducted and deposited, with quarterly statement receipt numbers and challan details.
Part CAnnexures with the salary, deductions and tax calculation.
Still unclear: published explanations differ on what each annexure is for, and on whether a paper copy is allowed. One says Form 130 must be issued electronically through TRACES, while another says digital or physical copies are fine. Plan on the TRACES route until you have checked the rule.

How it is produced

  1. Deduct tax from salary each month and deposit it on time.
  2. File the quarterly statement in Form 138.
  3. After processing, download the certificate from TRACES.
  4. Add the salary annexure and issue it to each employee by 15 June.

A certificate can only be right if the quarterly statements are right, so correct any PAN or challan errors before year end.

When someone changes jobs

  • Each employer issues Part A and Part B for the period the person worked there.
  • Part C can come from each employer, or from the last employer alone if the employee gives them the earlier salary and TDS details.
  • The new employer is told about earlier salary and tax in Form 127.

If you issue it late

Under the 1961 Act, the penalty for late Form 16 was reported as ₹500 a day. We did not find the matching provision for Form 130, so check it. Issue on time either way, because employees need the certificate to file their returns.

Form 16 in AiroHR

AiroHR prepares the employer's salary and tax annexure as a PDF, and employees see it in their portal alongside the TRACES part HR uploads. It is built for Form 16 today. The Form 130 layout will be needed for June 2027 and is not built yet, so check your figures against your Form 138 statements.
